Booking Conditions |
1. ReservationsA deposit of at least £200 (see invoice) per person is payable at the time of reservation, when you must complete and sign our official Booking Form. The person making the booking not only guarantees payment to us of total holiday booked, but does so no behalf of, and with the consent of all persons included in the booking and is therefore presumed to have informed them of these conditions and to have assumed their liabilities and responsibilities in terms thereof. We will send you written confirmation of your booking which will confirm exactly what is booked and what we have agreed to provide. Please check this carefully and advise us immediately of any changes/alterations in writing. The balance of the holiday costs must be paid no later than 8 weeks before departure and if the amount is not received by the due date we reserve the right to cancel the booking and levy cancellation charges as detailed in paragraph 3. (In the event that you book your holiday with a travel agent then any money which you pay the agent will be held by the agent at all times on our behalf. 2. Changes by youIf you wish to change details of your holiday booking you must let us know as soon as possible. If we can accept the changes, there will be an administration fee of £50 per person, per charge, plus any additional costs incurred. Changing dates or numbers traveling are major changes which we may treat as a cancellation and subsequent rebooking . Change of holiday requested within 10 weeks of departure may be treated as a cancellation and changes may be made as detailed in paragraph 3. 3. Cancellation by youIn the event that you, or any member of your party need to cancel your booking, or part of it, once it has been confirmed, you must do so in writing and you will be liable for cancellation charges as set out below, which depend on when we receive this notification.
4. Travel delays and unused servicesIn the event of travel delays either prior to departure, or during the course of any holiday we will not be held responsible for any extra costs incurred by the client (i.e Hotels, meals, drinks, refreshments, telephone calls etc). This is irrespective of whether the delays were brought about by technical difficulties, strikes, weather conditions or any other circumstances whatever, whether foreseen or unforeseen. No credit or refund can be given for any unused services (e.g transfers, hotel, accommodation, sightseeing) included in the basic holiday price, or loss, mislaid or destroyed travel documents. 5. Terms and conditions of carriageIf you holiday includes international carriage by air or sea this part of your holiday will be subject to the terms and conditions of the airline or shipping company. This is because carriage by these means is subject of international agreements between countries. We can provide you with a copy of these conditions on request and as part of your agreement with us, you agree to be bound by them. 6. Our guarantee of priceOur prices are based on currency exchange rates. The price of your holiday is subject to surcharges on the following items:- governmental action, currency, aircraft fuel, overflying charges, airport charges and increases in scheduled airfares. Even in this case, we will absorb an amount equivalent to 2% f the holiday price (excluding insurance premiums and amendment charges). If the surcharge results in you paying more than 10% of the holiday price, you will be entitled to cancel your holiday with a full refund of all monies paid except for any premium paid to us for the holiday insurance and amendment charges. Should you decide to cancel your holiday because of this you must exercise your right to do so within 14 days from the issue date of the surcharge invoice. Should a surcharge be required it will include an amount to cover agent’s commission and administration change. 7. If we change your reservationIt is unlikely that we will have to make changes to your holiday, but arrangements are made many months in advance and charges are sometimes necessary. Most changes would be minor, such as small alterations to departure times, and we reserve the right to make them at any time. We will inform you or your agent as soon as is reasonably possible should there be change to your arrangements. Sometimes we may have to make more material changes which may involve changing your hotel accommodation pr time of departure or return by more than 12 hours. In these cases you will have an alternative of:- a) Accepting charge(s) and any increase cost occasioned by utilization of more expensive hotels, in which case we will give you a credit towards the cost of your holiday on the scale shown below:- or b) Selecting alternatives with us, in which case we will refund all monies paid by you and in addition give you compensation on the scale shown below and the funds will be applied to the cost of the new holiday. In these circumstances we will not be liable for any other claim for compensation or expenses.
Please note: The compensation scales set out above do not apply when charges or cancellations are caused by events amounting to force majeure, this includes events such as war or threats of war, riots or civil strife, terrorists activities, industrial dispute, natural or nuclear disasters, fire, or adverse weather conditions, cancellations or charges of scheduled airlines and similar events beyond our control. In case of such events we will have no liability other then to offer comparable holiday if available, or to refund all the money paid by you. 8. If we cancel your holidayWe reserve the right in any circumstances to cancel you holiday. In the unlikely event we will offer you alternative holiday of comparable standard or return all monies paid by you to us. However we undertake not to cancel your holiday except for events amounting to force majeure (see above) after the date when the balance of your holiday cost has become due and been paid. 9. ComplaintsIf you have any complaint whilst on holiday you must advise our appropriate supplier and ourselves immediately. If after you return home you are still not satisfied you must write to us soon as possible but in any case no later then 4 weeks after you return from holiday so that we can investigate your complaint thoroughly while memories are still fresh and apart from apart from resolving your own complaint, it enables us to take corrective action to avoid other clients being inconvenienced. 10. Our liability to youWe accept responsibility for the acts and /or commissions of our employees, agents and suppliers. In addition we accept responsibility should the services which we are contractually obliged to provide prove deficient or not of reasonable standards. All accommodation and transport is provided by independent suppliers, for whom we will accept responsibility on the terms set out as follows: If you or any member of your party suffer death, bodily injury or illness arise from the negligence of our suppliers (other that air and sea carriers performing any domestic internal or international carriage of whatsoever kind for whom we accept no liability), their subcontractors servants and/or agents we will accept responsibility provided that they were acting within the scope of or in the course of their employment when the accident occurred. Where transport is by air, sea or rail their obligation and liabilities are limited in the manner provided by the relevant International Conventions. Should any payment be made to you or any member of your party by us in any of the circumstances referred to in this section, we reserve the right to claim in your place against the person or organisation responsible for causing the illness, injury or death. This means that you must agree to assign that part of your rights to us and we will be subrogated to those rights. Should you or any member of your party suffer illness, personal injury or death through any misadventure arising out of any activity which does not form part of your holiday arrangements, nor part of any excursion sold through us, we shall offer you every assistance we can. 11. Law and jurisdictionThese conditions form a contract between us which will be construed in accordance with English law and it is agreed between us that each will submit to the jurisdiction of the English courts.
